Terms and Conditions

1. General
1.1
Children aged 6 and older are eligible to participate. Children under 6 years of age may only participate in the sports camp after consultation with Hasekind UG/Socialsports.
1.2
The following conditions apply to the conclusion of the contract and all services provided by Hasekind UG/Socialsports. Deviating agreements shall only apply to a specific contract and not to any subsequently concluded contracts, unless expressly agreed otherwise.
1.3
No verbal collateral agreements have been made. All agreements, collateral agreements, and amendments to the contract must be made in writing.

2. Registration for the Sports Camps and Withdrawal from Participation
2.1
Upon receipt of the completed and signed registration form for the respective sports camp organized by Hasekind UG/Socialsports and receipt of payment, the participant is entitled to participate in this sports camp at the times and locations specified by Hasekind UG/Socialsports.
2.2
Due to limited participant capacity, Hasekind UG/Socialsports reserves the right to reject individual registrations for the sports camps.
2.3
If the minimum number of 30 participants per sports camp is not reached, Hasekind UG/Socialsports reserves the right to cancel the event up to 3 days before it begins. Registration and participation fees already paid will be fully refunded. The partner club will not incur any costs due to the cancellation.
2.4
Withdrawal from the concluded contract is possible at any time. In the event of withdrawal from the contract, the course fee will be refunded in full if the withdrawal takes place 2 weeks before the start of the course. In the event of withdrawal up to 1 week before the start of the booked event, 50% of the participation fee will be refunded. In the event of illness/injury during holiday care, a refund of the participation fee is not possible.

3. Participation Fees and Payment Terms

3.1
The registration and participation fees stated in the registration forms for the sports camps shall apply.
3.2
Payments must be made according to the payment terms specified in the sports camp registration forms by the due dates stated therein.
3.3
In the event of withdrawal or cancellation of a football camp, we will charge a processing fee of 10 Euros for refunds of the course fee.

4. Liability for Damages
4.1
Hasekind UG/Socialsports is liable for damages resulting from injury to life, body, or health, as well as for the breach of essential contractual obligations in accordance with statutory provisions.
4.2
Otherwise, the liability of Hasekind UG/Socialsports due to breach of duty and non-contractual liability, including liability for fault during contract negotiations, is limited to intent and gross negligence. Liability for gross negligence on the part of employees, staff, and vicarious agents is excluded, unless it concerns a breach of essential contractual obligations. In this case, the Sport mit Herz Stiftung is also liable for simple negligence.
4.3
Liability is limited to the typical contractual damage that Hasekind UG/Socialsports could have foreseen upon conclusion of the contract based on the circumstances known at that time.
4.4
Injuries and illnesses as well as any consequential damages must be covered directly by the legal guardians' private health and/or accident insurance.
4.5
Any further liability of Hasekind UG/Socialsports is excluded, regardless of its legal basis.
4.6
The above limitations of liability also apply accordingly to claims for reimbursement of futile expenses in accordance with § 284 of the German Civil Code (BGB).
4.7
Claims for damages against Hasekind UG/Socialsports, regardless of the legal basis, shall become statute-barred within five years from the legally regulated commencement of the limitation period. This does not apply to claims that are already subject to a shorter limitation period by law.
4.8
The above regulations do not involve a reversal of the burden of proof to the disadvantage of the participants.

5. Force Majeure
5.1
Unforeseeable, extraordinary events for which Hasekind UG/Socialsports is not responsible, such as operational disruptions, official measures, or other cases of force majeure, whether these events occur at Hasekind UG/Socialsports or any suppliers, release Hasekind UG/Socialsports from the respective contract; obstacles of a temporary nature, however, only for the duration of the impediment plus a reasonable lead time. If the execution of a football camp subsequently becomes impossible or unreasonable due to such events, both parties are entitled to withdraw from the contract.

6. Miscellaneous
6.1
Should individual provisions of these terms and conditions be or become invalid or unenforceable, or lose their validity or enforceability due to a subsequent circumstance, this shall not affect the validity of the remaining clauses. The parties undertake to find a provision that comes closest economically to the invalid or unenforceable provision.
6.2
Hasekind UG/Socialsports is entitled to store the participants' data received in connection with the business relationship in accordance with the provisions of the Federal Data Protection Act and, if necessary, to pass it on to its partners for advertising purposes.
6.3
Hasekind UG/Socialsports is entitled to use photos of the participants taken during the course of a sports camp for its own advertising purposes. The participant's legal representative gives the necessary consent on behalf of the participant.
6.4
Socially subsidized places for the sports camps are only awarded upon prior request and approval.
6.5
Hasekind UG administers the participant fees.
